Will it ever be permanently banned?
Wynn Resorts LTD. sought dismissal of the suit, claiming it is not their duty in Nevada state to protect their employees from second-hand smoking and also questioned the court's jurisdiction in the case. However, the judge disagreed, and allowed the Plaintiffs to proceed with the case.
This is not yet a clean-cut win for the employees, but can lead to a chain reaction. If the court rules Wynn Las Vegas has to ban smoking, other casinos will have to abide by the new rules.
As Jay Edelson, whose law firm, Edelson McGuire LLc is pursuing the case puts it:
"Worker safety is critical and well-recognized under the law. This is a tremendous decision for not only Wynn's employees, but also for workers at other casinos who for years have been unreasonably subjected to secondhand smoke,"
We will see how the case progresses, if the court rules in favor of the Plaintiffs, Las Vegas casinos will ban smoking faster than you can butt your cigarette.
